The expert report filed by the Respondents was written in the first and third persons with wording referring the expert “did this” instead of saying “I, expert, checked this”. The Court of Appeals misunderstood the facts and law per the record. The unsigned report was circulated as a valid and verified expert report violating Petitioners’ Constitutional Rights. The report also was flawed with deficiencies in breach of Fed. R. Civ. P. 26(a)(2) the Court ignored Fed. R. Civ. P 26(g)(2) and 26(g)(3).
